Dinetodate.com Limited Terms and Conditions
1. Introduction
This is a legal agreement ("Agreement”) between you and Dinetodate.com Ltd; a company registered in England and Wales, company number 6888521 and whose registered office is 13 Badgers Copse, Frimley, Camberley, Surrey, GU15 1HW.
Please read these terms and conditions carefully before using this Website. When registering as a Member or using the Website whether or not you register as a Member indicates that you accept and are bound by these terms. If you do not accept these terms you must not register as a Member or use the Services.
This Agreement is subject to change by Dinetodate.com Ltd in its sole discretion with or without notice at any time. Your continued use of this site following revisions of this Agreement confirms your acceptance of any revisions. Dinetodate.com Ltd may offer additional services or revise any of the Services with or without notice and this Agreement will apply to all additional services or revised services.
2. Eligibility
You must be 18 years or over to register as a Member of Dinetotdate.com Ltd. You are not eligible if you have been convicted of any offence or subject to any court order relating to assault, violence, sexual harassment or misconduct. Dinetodate.com Ltd does not currently conduct Criminal Background Screenings on its members.
3. Use of Site and Services
Your account is for your personal use and you will ensure that all contact and payment details (such as Email and postal addresses and credit card details) which you provide to us are accurate and kept up to date. You are responsible for keeping your username and passwords confidential. You agree to notify Dinetodate.com Ltd of any unauthorised use of your username and password or any other breach of security and ensure that you exit from your account at the end of every session. Dinetodate.com will not be liable for any loss or damage arising from your failure to comply with these terms.
You are solely responsible for and assume all liability regarding the information and content you post or publish or otherwise make available to other registered users through Dinetodate.com Ltd.
4. Safety and Security
We do not have the contractual obligation or technical means to verify the identity of persons who register as Member or use our Services. You should not assume that any Member content is accurate. A Member may not be who he or she claims to be. We cannot be liable for any false or misleading information by Members.
We are not liable if your identity is used by someone else.
When arranging to meet with other people through Dinetodate.com Ltd you must take appropriate precautions. Any such meetings are at your own risk and are not our responsibility.
5. Posting Content and Restrictions
You will agree not to post on any of the Services, transmit to other users, communicate any content or engage in any activity on the Site that:
- promotes racism, bigotry, hatred or physical harm of any kind against any group or individuals:
- harasses, annoys, threatens or intimidates any other users of the Services:
- promotes information that you know is false, misleading or promotes illegal activities or that is abusive, threatening, obscene, defamatory or libellous:
- collects or provides material or personal information that exploits people under the age of 18:
- uses the site or services for junk mail, chain letters or spam e-mailing;
- promotes or enables illegal activities such as making or buying illegal weapons or drugs violating someone’s privacy, obtain other’s identity information, providing or creating computer viruses;
- intends to defraud, swindle or deceive other users of the Services;
- contains any material which violate any third party’s rights;
- do anything which may have the effect of disrupting the Services such as worms, viruses, trojan horses, software bombs, mass mailings or other harmful components or devices;
- reveal through the Services any information that enables you to be identified other than through the Services including postal/email addresses, last name or telephone numbers;
- contains other copyrighted content (music, photographs, images, videos, software etc) without obtaining permission first;
6. Proprietary Rights
Dinetodate.com Ltd owns and retains all proprietary rights in the Website and the Service. The Website contains the copyrighted material, trademarks and other proprietary information of Dinetodate.com Ltd and its licensors.
Except for information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, perform, reproduce, distribute, licence, transfer display or sell or re-sell any intellectual property or proprietary or copyrighted information.
7. Member Information
For information about the collection and possible use of information and material provided by you, please see our Privacy Policy located on the Site. By using the Site or Services you are consenting to the terms of Dinetodate.com Ltd’s Privacy Policy.
We allow Members to notify us of behaviour which could be regarded as inappropriate or whose conduct is illegal or unlawful. You must notify us in writing immediately if you become aware of any inappropriate behaviour in connection with the services.
We are not liable for activities of Members which may breach the rights of other Users or third parties.
You agree that you will not post any e-mail addresses, personal website addresses or profile page that you may have on a third party website, contact information or any other communications you may have with other users.
You agree that you will not provide inaccurate, misleading or false information to Dinetodate.com Ltd or to any other User.
Dinetodate.com reserves the right to investigate and terminate membership and remove from our Services all or part of any Member Profile.
This Agreement is subject to change by Dinetodate.com in its sole discretion at any time, with or without notice. You will be deemed to have accepted any such revisions if you continue to use the Service after the posting of these revisions.
8. Third Party Websites
The Services may contain links to websites of third parties, Dinetodate.com Ltd is not responsible or endorses such sites and nor are we responsible for the goods or services offered on such sites and therefore are used at your own risk. Your correspondence or dealings with third parties are solely between you and such sites and that you agree that Dinetodate.com Ltd will not be in any way whatsoever responsible or liable for any claim, loss or damage of any sort incurred directly or indirectly as the result of such dealings.
9. Site and Service Access
Whilst Dinetodate.com Ltd endeavours to ensure that this Website is accessible 24 hours a day, we do not guarantee that the Service will be uninterrupted or error free.
We reserve the right to suspend the Services at any time without notice in the case of system failure, maintenance, repair or improvement or for reasons beyond our control.
10. Disclaimer
The content of this Website and its Services are provided without any conditions, warranties or other terms of any kind. Hence, to the maximum extent permitted by law, Dinetodate.com Ltd provides you with this Website on the basis that Dinetodate.com Ltd excludes all representations, warranties, conditions and other terms including without limitation the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable skill and care which but for this legal notice might have effect in relation to this Website.
Dinetodate.com Ltd does not warrant that your use of the Services will be secure, uninterrupted, always available, error free or will meet all your requirements or that any defects within the Service will be rectified.
You acknowledge that any reliance upon such opinion, members profiles or information is at your own risk.
We are not responsible for the conduct of Members whether on-line or off-line.
Dinetodate.com makes every effort to ensure the accuracy and reliability of the information contained for Walk This Way. However Dinetodate.com and its employees will not be held responsible for any form of loss or misinformation occuring due to the use of or reliance upon the information provided upon this site.
Dinetodate.com assumes no responsibility for errors, ommisions, technical errors or typographical errors contained within this site or for any personal injury or loss of personal belongings.
11. Limitation of Liability
Nothing in this Agreement shall exclude or limit Dinetodate.com Ltd’s liability for (i) death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977); or (ii) fraud or (iii) misrepresentation as to a fundamental matter.
To the maximum extent permitted by applicable law, under no circumstances will Dinetodate.com Ltd be liable or responsible for any kind of loss or damage from including without limitation any direct, indirect, consequential or incidental loss or damages, or any loss of income, profits, goodwill, loss or corruption of data/programs in connection with the use, inability to use or the results of use of this Website.
Dinetodate.com Ltd’s liability to you in any form whatsoever in connection with this Agreement or the use of Services of this Site will at all times be limited to the amount paid if any by you to Dinetodate.com Ltd for the Service during the term of membership.
12. Terms and Termination
This Agreement will remain in full force and effect whilst you are a member of the Service. If you are a "consumer” as defined in the Consumer Protection (Distance Selling) Regulations 2000, resident within the EU you may cancel your order for the Services by providing us with written notice within seven working days of placing your order. Within 30 days of your notice we will provide a refund. If you opt to become a Member and enter the Website, you are electing to commence the Service immediately and you thereby waive any right to cancel the Service under the above Regulations.
You may cancel your membership with us at any time but we require 14 days notice, for any reason effective upon receipt by Dinetodate.com of your written or email notification of cancellation. If you terminate your membership, the membership will remain active until the end of the period through which you had paid prior to your termination. We cannot issue refunds for any fees paid prior to tendering your 14 day notice to quit.
We reserve the right to immediately terminate your membership and your access to the Service or Site. In the event your membership to any of the Services is suspended due to the breech of this Agreement, you agree that all fees then paid to Dinetodate.com by you will be non refundable and all outstanding or pending payments will be due immediately.
13. Indemnification
You agree to indemnify (maximum extent permitted by applicable law) Dinetodate.com Ltd, its directors, officers, employees, agents and third parties for all claims, causes of action, debts, losses, costs, liabilities and expenses related to your breach of this Agreement and/or to your use of the Services.
14. Renewals
In order to provide a continuous service, Dinetodate.com automatically renews all paid subscriptions for Services 24 hours before such subscriptions expire. Renewals are generally for the same duration as the original subscription, 1 month subscription will renew on a monthly basis, a 3 month subscription will renew on a 3 month basis and a 6 month subscription will renew on a 6 month basis. In addition Dinetodate.com may offer special promotions that have renewal periods of different duration than the standard 1, 3 and 6 month subscriptions. By entering into this Agreement, you acknowledge that your account will be subject to the above described automatic renewals. If you do not wish your account to renew automatically, please follow the directions set out under Terms and Termination in order to cancel your subscription prior to the renewal date.
15. General
This Agreement accepted upon use of the Website and affirming to become a Member of the Service constitutes the entire Agreement between you and us in connection with the Service. If any provision of this Agreement is held invalid the remainder of the Agreement shall continue in full force.
This Agreement does not create any rights under the Contracts (Rights of Third Parties) Act 1999 which are enforceable by any person who is not party to this Agreement.
16. Controlling Law and Jurisdiction
You agree that English Law will govern this Agreement and any disputes will be decided only by the English Courts.
